Civil Court Trial Management Order

One week before trial, counsel and pro se parties are to file with the court, through the Caseflow Coordinator, on pleading paper a joint trial management conference report providing the following information:

  1. A joint brief, non-argumentative description of the case.
  2. A joint list of issues that are in dispute.
  3. A joint list of pending motions, pending requests for discovery and proposed motions in limine.
  4. A list of exhibits reasonably expected to be introduced by each party, indexed by P plus number for plaintiff(s) and by D plus number for defendant(s). The list shall briefly describe each exhibit and indicate whether any party objects to the admission of such exhibit as well as the grounds for such objection. COUNSEL SHALL MARK ALL EXHIBITS AS FULL EXHIBITS OR FOR IDENTIFICATION PRIOR TO COMMENCEMENT OF TRIAL.
  5. A list of all witnesses reasonably expected to be called by each party in the sequence in which they will be called, including the name and relationship of each witness to the case (e.g. party, eyewitness, expert) and whether there is a scheduling problem as to the testimony of any such witness. Rebuttal witnesses, i.e., those whose testimony is meant to rehabilitate, explain, qualify, negate or contradict that which has been presented during the defendant’s case, need not be listed by the plaintiff. Likewise, surrebuttal witnesses, i.e., those whose testimony is meant to refute the plaintiff’s rebuttal evidence, need not be listed by the defendant.

If this case goes forward on the day it is scheduled as a backup, counsel shall submit the joint trial management report on the day of trial.

Counsel shall have all exhibits premarked by 9:45 a.m. on the morning of trial.

Counsel shall report the status of the case five business days before trial to the Caseflow Coordinator 860-447-3472.

Failure to comply with this order may result in a judgement of non-suit, default, exclusion of exhibits or witnesses at trial or other sanctions.
