5.2-4 CUTPA - Offends Public Policy
Revised to January 1, 2008
The plaintiff asserts that
the defendant's <insert conduct> constituted an unfair trade
practice because it "offends public policy." The public policy of
the State of Connecticut is <describe policy>. You must
decide whether the defendant's conduct offended that public policy.
[<If violation of a
statute is claimed:> Violation of a statute does not
automatically result in a CUTPA violation. Therefore, even if you
find that the defendant violated a statute, you must still decide
whether the plaintiff has proved that the defendant's statutory
violation "offends public policy."]
