3.9-18 Defendant Does Not Guarantee Safety

It is not the law that the
plaintiff is entitled to compensation merely because (he/she) is
injured while on the premises controlled by another. The defendant
is not required to guarantee the safety of all persons on the
premises. Rather the defendant is only liable for the resulting
injuries if the plaintiff meets the burden to prove the necessary
elements of a defective premises claim as I now outline them for
you.
