Replevin Action - 9/09/05

  1. Writ of Replevin
  2. Affidavit from the Plaintiff or some other credible person stating:

  3.      a. the true and just value of the goods to be replevied, and that
         b. the Plaintiff is entitled to immediate possession of the goods
  1. Recognizance bond with at least one surety in a sum at least double the sworn value of the property (See C.G.S. Sec. 52-518(2))External Link - You are leaving the Connecticut Judicial Branch website or a cash bond in a sum at least double the sworn value of the property.

  1. Entry fee: The current fee is $300.

The following documents required for an application for a PJR to be issued subsequent to a hearing (C.G.S. Sec. 52-278c)External Link - You are leaving the Connecticut Judicial Branch website must be filed:

  1. Notice of Application for Prejudgment Remedy/Claim for Hearing to Contest Application or Claim Exemption (form JD-CV 53)
  2. Application for PJR
  3. Affidavit by the plaintiff or competent affiant containing statement of facts sufficient to show probable cause that a judgment in the amount of the prejudgment remedy sought, or in an amount greater than the amount of the prejudgment remedy sought, taking into account any known defenses, counterclaims or set-offs, will be rendered in the matter in favor of the plaintiff.
  4. Order for hearing and notice
  5. Summons for hearing

In addition, the Plaintiff must submit:

  1. A proposed unsigned Writ of Replevin

  2. An affidavit from the Plaintiff or some other credible person stating:
         a. the true and just value of the goods to be replevied, and that
         b. the Plaintiff is entitled to immediate possession of the goods

  3. Proposed recognizance bond with at least one surety in a sum at least double the sworn value of the property (See C.G.S. Sec. 52-518(2))External Link - You are leaving the Connecticut Judicial Branch website or a cash bond in a sum at least double the sworn value of the property
  4. Application fee. The current fee is $475: $300 entry fee plus $175 PJR fee.
